First Lawsuits Filed in New Vine Meltdown

Two lawsuits, one of them requesting class-action status, have been filed against New Vine Inc. in Napa County Superior Court.

CLASS ACTION CHARGES WAGE, VACATION PAY, OTHER VIOLATIONS

San Francisco Attorneys Jeremy Pasternak and Joshua Konecky filed a lawsuit on Monday, June 8, on behalf of New Vine employee Tristan Fairbanks.

The civil complaint, which has requested class-action status charges, among other things, violations relating to:

  • Failure to pay wages upon termination,
  • Failure to pay vacation pay upon termination,
  • Claims for waiting time penalties.

Ms. Fairbanks was an account manager in New Vine’s client services department.

Pasternak is with the Law Offices of Jeremy Pasternak. Konecky is with the firm of Schneider Wallace Cottrell Brayton Konecky

A case management conference has been set for Nov. 16.

TECH LABOR CONTRACTOR SUES FOR CONTRACT VIOLATION

iTalent, a Santa Clara company which New Vine hired to provide engineering labor for a computer system upgrade, filed suit on June 2 for breach of contract. iTalent wasd responsible for New Vine’s Oracle applications upgrade.

According to court documents, iTalent says that New Vine owes it “more than $375,000.”

A case management conference has been set for Nov. 9.
